A. GENERAL

Your use of the website iPolytek.com (the "Service" or the "Website") owned by Formation iPolytek inc. ("iPolytek") is conditional upon your acceptance of the terms and conditions contained in this Agreement. iPolytek reserves the right, in its discretion, to change or modify all or any part of this Agreement at any time. Your continued use of the Service constitutes your binding acceptance of this Agreement, including any changes or modifications made by iPolytek as permitted above.


B. USE OF CONTENT

You acknowledge that the Service may contain information services, information, interactive forums, software, photographs, audio and video clips, graphics, online courses and other content (collectively, "iPolytek Content") that is protected by copyright, trademark or other proprietary rights of iPolytek. In addition, the Service may contain information, online courses and other content provided by third parties ("Third Party Content", together with "iPolytek Content", the "Content") that is protected by copyright, trademark or other proprietary rights of such parties. All Content on the Service is copyrighted as a collective work of iPolytek pursuant to applicable copyright law. You agree to comply with any additional copyright notices, information, or restrictions contained in any Content available on or accessed through the Service. Except as expressly permitted by the copyright laws, no copying, storage, redistribution or publication of the Content is permitted without the express written permission of iPolytek.


C. IPOLYTEK REFUND POLICY

Due to the digital nature of our courses, we do not issue refunds. We encourage you to preview our courses and download the course notes for free before purchasing. Many of our courses can be viewed for free on YouTube as well. 


Our courses are written to meet the professional development requirements defined by the orders of engineers of the provinces of Canada and most US states (see note below). However, it is the engineer’s responsibility to determine whether an activity meets the guidelines set by their licensing body. It is also the engineer's responsibility to maintain and submit records of professional development activities to their engineering board.


ATTENTION ENGINEERS FROM FL, NY, NJ, NC, MD, IN: 

The engineering boards of Florida, New York, New Jersey, North Carolina, Maryland, and Indiana require pre-approval of professional development course providers. iPolytek has not yet sought to be approved in these states. Therefore, engineers from the states listed above are advised to not purchase any courses from iPolytek for the purpose of accumulating professional development hours

This site contains web links to other sites. iPolytek is not responsible for the privacy practices or the content of linked websites.


E. WARRANTIES

(1) iPolytek does not warrant that the Service will be uninterrupted or error-free; nor does iPolytek make any warranty as to the results to be obtained from the use of the Service or the Content. The Service and the Content are distributed on an "as is, as available" basis. iPolytek makes no warranties of any kind, either express or implied, with respect to the Service, any content or any products or services sold through the Service. (2) iPolytek shall not be liable for any direct, indirect, incidental, special or consequential damages arising out of the use of or inability to use the Service.

The materials contained in the online courses are not intended as a representation or warranty on the part of iPolytek or any other person/organization named herein. The materials are for general information only. They are not a substitute for competent professional advice. Application of this information to a specific project should be reviewed by a registered professional engineer. Anyone making use of the information set forth herein does so at their own risk and assumes any and all resulting liability arising therefrom.


G. INDEMNITY

You agree to hold harmless and indemnify iPolytek and its officers, directors, owners, agents, Content providers, affiliates and licensors (collectively, the "iPolytek Parties") against all claims, losses, court fees, and attorney fees arising out of the services provided under this Agreement.


H. APPLICABLE LAW AND JURISDICTION

Your use of the Service and the Terms of Use are governed by the laws of the Province of Quebec and the laws of Canada, without regard to principles of conflict of laws. You hereby acknowledge that any dispute arising out of or relating to your use of the Service or the Terms of Use will be subject to the jurisdiction of the judicial district of Bedford, province of Quebec.
